ESOS Phase 3 Compliance Update

The Environment Agency (EA) have recently announced flexibility in their approach for the ESOS Phase 3 deadline, owing to EA’s ‘How to Comply’ guidance and delays in finalising the IT system.

Reporting System

The Manage your Energy Savings Opportunity Scheme reporting system (MESOS) is set to go live on Tuesday 19th March 2024. Initially participants will be allowed to register their phase 3 user and organisational accounts followed by a further release in April which will permit participants to start filling in their notifications of compliance. The second release is planned for the second half of April 2024 and the date for this will be confirmed by the end of March 2024.

 

Enforcement Extension

For organisations qualifying for Phase 3 of ESOS, the deadline for submitting a compliance notification is the 5 June 2024 and organisations should still look to meet this compliance notification deadline where possible. However, the Environment Agency and Regulators for the Devolved Administrations will not take enforcement action against you if you do not comply with this legal requirement provided that you meet both the following conditions:

  • registration of your account in the new IT system has been completed by the 5 June 2024, and
  • you submit your notification of compliance by the 6 August 2024

This is in response to stakeholder representations made to UK Government and the Environment Agency on the implementation of ESOS Phase 3, including in relation to the Environment Agency’s ‘How to Comply’ guidance and delays in finalising the new ESOS IT system.

This regulatory enforcement extension period will cease after the 6 August 2024.

 

Don’t miss the deadline!

Failure to comply with ESOS regulations can lead to:

  • Fixed penalties of up to £50,000
  • Additional penalties of £500 for each working day until the breach is remedied
  • Being listed as non-compliant on the government website
